HERMITAGE —
David Construction Co. of Hermitage and the laborers’ union are headed to non-binding arbitration as part of a lawsuit that alleges the company has failed to pay fringe benefit contributions or wages deductions as required by a contract.
Laborers’ Combined Funds of Western Pennsylvania sued David July 3, alleging the company failed to pay $30,839 in principal for the period January 2011 through February 2012.
The union also is seeking interest and damages, bringing the total to nearly $40,000.
In its answer, David denied the allegations and said it has paid wage rates in excess of contract amounts, deducted union dues and paid the money to the union.
U.S. District Court Judge Arthur J. Scwhab, Pittsburgh, ordered Friday that arbitration occur by Oct. 17, and set a bench trial for Nov. 20.
